Gratitude
We love our fans and we love what we make. To have the opportunity to be supported as we pursue our dark and ambitious creations continues to be humbling and amazing. To that end, despite delays, we always strive to improve our projects and to deliver goods beyond expectations. We also acknowledge that we can be very slow.
We have a wonderful support team, and we try to work with fans on a case-by-case, person-to-person basis. Whatever the issue is, please reach out to us and we will do our best to make exceptions and find a solution.

## 1. Introduction
Welcome to Adam Poots Games, LLC ("we," "us," or "our"). We design and sell horror-themed board games, models, artwork, and software. We take protecting your personal information seriously. This Privacy Policy explains how we collect, use, share, and protect information about you when you visit our website, make a purchase, or otherwise interact with us.
We sell and ship worldwide, so different privacy laws may apply depending on where you live. That includes the laws of the United States and individual U.S. states, the European Economic Area (EEA), and the United Kingdom (UK). Your rights under those frameworks are described in Section 11.
If you have questions or concerns, contact us at support@kingdomdeath.com.
---
## 2. Mature Content & Age Requirement
Our products and website contain content intended for mature audiences only. This includes graphic horror, gore and body horror, partial nudity and suggestive ("pin-up" style) artwork, and psychological themes. This site is not directed to, or intended for, minors.
By visiting this site or making a purchase, you confirm that **you are of legal age to view mature content and to make purchases under the laws of your country and state or region**. A valid PayPal account or credit/debit card is required to complete any purchase.
We do not knowingly collect personal information from children. Our services are intended only for adults, and in particular we do not knowingly collect personal information from any child under the age of 13 (as defined under the U.S. Children's Online Privacy Protection Act, "COPPA"). If you believe a minor has given us personal information, contact us at support@kingdomdeath.com and we will delete it promptly.
---
## 3. Our Approach: We Collect Only What We Need
We follow a principle of **data minimization**. We only collect the personal information we actually need to fulfill your order and provide the services you ask for, and we collect it with your knowledge and consent during checkout or account creation.
We rely on established platforms to run our store, primarily **Shopify** (which hosts and operates the store) and **Mailchimp** (our email provider). Most automatic data collection on our site is done by those platforms rather than by us directly. **As of the "Last Updated" date above, we do not ourselves operate independent third-party analytics (such as Google Analytics) or advertising or retargeting pixels (such as the Meta Pixel).** Shopify does collect device and usage data and runs its own analytics and fraud-prevention tools in order to provide, secure, and improve the store. We describe this in Sections 6 and 7 and link to the providers' own privacy policies so you can review their practices in full. If we add any analytics or advertising technologies in the future, or install a third-party app or integration that collects personal data, we will update this policy first and, where required, ask for your consent.
---
## 4. Information We Collect
### Information you provide directly to us
- **Contact information:** name, email address, phone number, billing and shipping address
- **Payment information:** credit/debit card or PayPal details. Payments are processed securely through Shopify Payments and/or PayPal. **We do not store your full card number.**
- **Account information:** username and password if you create an account
- **Purchase history:** products ordered, order dates, and amounts
- **Communications:** messages you send us by email or through contact forms
- **Third-party recipient data:** if you ship an order to someone else (as a gift, for example), we collect that person's name and shipping address solely to fulfill delivery. We are not responsible for how recipients use or share their own information.
- **Gift card data:** if we offer gift cards, we collect the information needed to issue, track, and fulfill those transactions, including the purchaser's and recipient's email addresses where applicable.
- **The Dark Treasury account data:** pre-order, pledge, and fulfillment notification preferences, backer/pledge status, pledge selections, and cart activity associated with your Dark Treasury account (see Section 9).
### Information collected automatically (by our platforms, not by us directly)
When you visit our site, our e-commerce platform Shopify automatically collects certain **device and browsing information** on our behalf, including:
- Web browser version, IP address, and time zone
- Cookie information and similar identifiers
- Pages and products you view, search terms used, and how you interact with the site
Shopify uses your IP address and related data in part to **screen orders for potential fraud and risk.** We do not separately collect this information ourselves, and we rely on Shopify's documentation for the full detail of what is gathered. You can read Shopify's Consumer Privacy Policy at https://www.shopify.com/legal/privacy/consumers
---
## 5. How We Use Your Information
We use your information to:
- Process and fulfill your orders (physical board games, models, artwork, and software)
- Send order confirmations, shipping updates, and receipts
- Deliver software licenses or digital downloads you have purchased
- Respond to your questions and provide customer support
- Send you marketing emails and promotions (**only if you have opted in**)
- Improve our website and product offerings
- Detect and prevent fraud, including automated fraud screening performed by Shopify on our behalf
- Comply with our legal, tax, and accounting obligations
### Legal bases for processing (EEA/UK customers)
If you are located in the EEA or UK, we process your personal data on the following legal bases:
- **Performance of a contract:** to process and deliver the orders you place with us.
- **Consent:** for marketing emails and any optional information you choose to provide. You may withdraw consent at any time.
- **Legitimate interests:** to operate, secure, and improve our store and to prevent fraud, balanced against your rights.
- **Legal obligation:** to retain records and comply with tax, accounting, and other laws.
---
## 6. How We Share Your Information
**We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising** (as those terms are defined under U.S. state privacy laws). We share information only with the service providers and parties below, and only as needed:
- **Shopify:** our e-commerce platform, which hosts our store, processes transactions, and performs automated fraud analysis. For most order-related purposes, Shopify acts as a **data processor** on our behalf, so if you have questions or requests about your personal data, contact us directly (see Section 17). For certain platform-level services (such as its payment and fraud-prevention networks, sometimes described as "Network Intelligence," which may combine data across merchants to detect fraud), Shopify may act as an **independent controller** of your data. You can review how Shopify handles data at https://www.shopify.com/legal/privacy
- **Payment processors (Shopify Payments, PayPal):** to securely complete your transaction. We do not store full card numbers.
- **Shipping carriers (e.g., UPS, USPS, FedEx, and international carriers):** to deliver your order. We share only the name and address needed for delivery.
- **Email marketing platform (Mailchimp):** as described in Section 8.
- **Software delivery providers:** platforms used to deliver your digital game license or download.
- **Legal authorities:** if required by law, court order, or to protect our rights.
- **Business successors:** if our business is sold, merged, or restructured, your personal information may be transferred to the acquiring party. We will require any successor to use your data only in accordance with this Privacy Policy, and we will notify you of any material changes.
If you give us personal information about another person, such as a shipping recipient, you confirm that you have that person's permission for us to use their information as described in this policy.
### International data transfers
Because we operate worldwide and use U.S.-based service providers (including Shopify and Mailchimp), your personal information may be transferred to, stored in, and processed in the United States or other countries whose data-protection laws may differ from your own. Where required for EEA/UK transfers, our providers rely on appropriate safeguards such as Standard Contractual Clauses. By using our site or placing an order, you understand that your information will be handled as described in this policy.

## 7. Cookies & Tracking Technologies
Our site uses cookies and similar technologies, primarily through Shopify, to:
- Keep items in your shopping cart
- Remember your login session and preferences
- Support email marketing performance tracking (through Mailchimp)
**Analytics & advertising:** We do not currently use third-party analytics tools (such as Google Analytics) or advertising/retargeting pixels (such as Meta Pixel). If we add any in the future, we will update this policy to describe what data is collected and how it is used, and where required we will ask for your consent first (for example, through a cookie banner).
**Consent (EEA / UK visitors).** Where required by law, we ask for your consent before placing non-essential cookies (for example, certain preference or marketing-performance cookies), and you can accept, reject, or manage these at any time through the cookie controls on our site. **Strictly necessary** cookies, such as the ones that keep items in your cart or maintain your login session, do not require consent because the site cannot function without them. We use a consent management tool (such as Shopify's built-in customer-privacy / consent banner) to record and honor your choices. UK law now allows certain low-risk analytics and functionality cookies without consent; where we rely on that, we will still tell you about them here and give you a way to turn them off.
You can also control cookies through your browser settings. Disabling cookies may affect parts of our site, such as the shopping cart.
**Do Not Track (DNT):** There is no industry-wide standard for how DNT signals should be interpreted, so our store does not respond to them at this time.
**Global Privacy Control (GPC):** Where required by applicable law (for example, for California residents), we treat a recognized opt-out preference signal such as GPC as a valid request to opt out of the "sale" or "sharing" of personal information. As noted above, we do not sell or share personal information for advertising, so in practice there is nothing to opt out of. We will honor these signals if that ever changes.
---
## 8. Email Marketing
If you opt in to our email list, we use **Mailchimp** to send you promotional emails, product announcements, and special offers. Each marketing email includes an unsubscribe link. You may opt out at any time by clicking "Unsubscribe" in any email or by contacting us directly.
We share your email address and purchase history with Mailchimp solely to send you these communications. Under our agreement with Mailchimp, they are not permitted to use your data for their own unrelated purposes. You can review Mailchimp's privacy practices at https://www.intuit.com/privacy/statement/
---
## 9. The Dark Treasury (Beta Feature)
The Dark Treasury is a registered-user feature that lets you receive notifications when a pre-order or crowdfunded project reward becomes available for fulfillment, add those items to your cart for checkout, and from time to time make new pledges for items we offer through it.
**Data we collect for this feature:** your email address, account preferences, notification settings, backer or pledge status, and cart activity associated with your Dark Treasury account. We use this information solely to operate the feature and notify you about availability.
The Dark Treasury is currently in **beta**. Our customer support team is available to help with any issues, though resolution times may vary while the feature is in beta. If you run into a problem, contact us at support@kingdomdeath.com.
> **Note:** The terms governing the beta nature of this feature (service availability, "as-is" provision, and limitation of liability) are in our Terms of Service, not in this Privacy Policy. This section covers only how we handle your data.
---
## 10. The Digital Game (Downloadable Client & Online Service)
When you buy and play our **Digital Game** (the downloadable client and any expansions; see Section 8 of our Terms of Service), we collect and retain a limited set of information:
- **Account credentials:** the username and password you use to sign in (your password is stored securely)
- **IP address:** collected when your client connects to our online service, used to operate and secure the service
- **Purchase and license data:** your email address, license key and activation/entitlement data, purchase date, and transaction ID, used to deliver, validate, and support your purchase
We use this information solely to deliver and run the Digital Game, sign you in, validate your license, provide support, and keep the service secure. We do not use it to track you for advertising.
---
## 11. Your Privacy Rights
### U.S. residents
Depending on your state, you may have the right to:
- **Access / know** the personal information we hold about you
- **Correct** inaccurate data
- **Delete** your personal data, subject to certain exceptions (e.g., records we must keep for legal or tax purposes)
- **Data portability:** receive a copy of your data in a portable format
- **Opt out** of the sale or sharing of personal data and of targeted advertising and certain profiling (note: we do not engage in any of these)
- **Non-discrimination** for exercising your rights
**California residents (CCPA/CPRA):** You have the rights listed above, including the right to know, delete, correct, and opt out of the sale or sharing of personal information. We do not sell or share personal information.
> *U.S. state privacy laws are expanding quickly, and the specific rights available to you may depend on your state of residence. We honor the rights described above for all U.S. customers as a baseline.*
### EEA & UK residents (GDPR / UK GDPR)
If you are in the EEA or UK, you have the right to: access your data; correct inaccurate data; request erasure ("right to be forgotten"); restrict or object to processing; data portability; and withdraw consent at any time (without affecting prior processing). You also have the right to lodge a complaint with your local data protection authority.
To exercise any of these rights, contact us at support@kingdomdeath.com. We will respond within the timeframes required by applicable law. We may need to verify your identity before fulfilling your request.
**Complaints.** If you are unhappy with how we have handled your personal data, you can complain to us directly at support@kingdomdeath.com. We will acknowledge your complaint within 30 days, look into it, and tell you what we have done about it. You can do this before, instead of, or as well as contacting your data protection authority.
**EU and UK representatives (GDPR Article 27).** *[To be completed or removed after legal review. See Counsel Notes.]* If we are required to appoint representatives under Article 27 of the EU GDPR and UK GDPR, our EEA representative is **[Name, postal address, email]** and our UK representative is **[Name, postal address, email]**. You may contact the relevant representative on data-protection matters, in addition to contacting us using the details in Section 17.
---
## 12. Data Retention
We keep your personal information only as long as necessary for the purposes described in this policy. Specifically:
- **Order and transaction records:** typically retained for 7 years for tax and accounting purposes.
- **Account and Dark Treasury data:** retained while your account is active; deleted or anonymized on request, subject to legal-retention exceptions.
- **Marketing data:** retained until you unsubscribe or request deletion.
- **Digital Game and license data:** retained as long as needed to deliver the Digital Game, validate your license, and provide support.
---
## 13. Security
We take reasonable technical and organizational measures to protect your personal information. Payment data is encrypted in transit via SSL/TLS, and payments are handled by PCI-compliant processors (Shopify Payments, PayPal). No method of transmission over the internet is 100% secure, however, and we cannot guarantee absolute security.
---
## 14. What Happens If You Do Not Provide Information
Certain information is required to process and fulfill your order. If you choose not to provide it (a shipping address or payment details, say), we may be unable to complete your purchase or provide the services you requested. Optional information, such as marketing opt-ins, will not affect your ability to place an order.
---
## 15. Third-Party Links
Our website may contain links to third-party websites (e.g., board game review sites, rulebook PDFs, Kickstarter). We are not responsible for the privacy practices of those sites and encourage you to review their policies.
---
## 16. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will take reasonable steps to notify you, such as a notice on our site or by email where appropriate. Continued use of our store after changes are posted constitutes your acceptance of the revised policy.
